E. Article XII, N.D.R.Ct.; Collections
The Committee will consider a new set of rules governing collections. Under N.D.R.Ct. 12.1, the rules would be applicable to collection agencies and attorneys who file collection actions. Proposed N.D.R.Ct. 12.2 contains requirements for pleadings. Proposed N.D.R.Ct. 12.3 contains a list of documents that must be filed to obtain a default judgment. Proposed N.D.R.Ct. 12.4 requires an execution to issue before discovery may proceed; and after judgment, any further proceedings must proceed under N.D.R.Civ.P. 4 service.
